Terms and Conditions for the supply of products from The Climbing Book Shop
The contract between us
a. Any contract for purchases made through the website will be with Gareth Hanson, trading as The Climbing Book Shop, 24 Westfield Rise, Hessle, East Yorkshire, HU13 0NB.
b. The Climbing Book Shop must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Payment is taken at the point you order the goods. Once payment has been received The Climbing Book Shop will confirm that your order has been received by sending you an email to you at the email address you provide to Paypal. The shipment email will contain just the details of your order and the total price paid. The Climbing Book Shop’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
c. The Climbing Book Shop is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.
Withdrawal by you from the contract
If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here. This right to withdraw does not apply to business buyers.
a. You may withdraw your order for goods at any time up to the end of the twenty first working day after you have received the goods. You do not need to give The Climbing Book Shop any reason for withdrawing your order nor will you have to pay any penalty.
b. The only circumstance in which you cannot withdraw your order is where the product is a DVD or CD.
c. To withdraw your order you must notify The Climbing Book Shop in writing at the address set out in the Climbing Book Shop’s returns page of this website.
d. If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to The Climbing Book Shop’s return address at your own cost and risk, unless the goods were supplied faulty or damaged. If you withdraw your order but The Climbing Book Shop has already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to The Climbing Book Shop at the The Climbing Book Shop’s return address at your own cost and risk as soon as possible.
e. Once you have notified The Climbing Book Shop that you are withdrawing your order, any sum debited to The Climbing Book Shop from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.
Availability of goods you order
We will always endeavour to deliver your goods within the delivery time stated on our web site. If for any reason we can’t make this deadline, we’ll inform you by email and give you the opportunity to cancel the order, in which case we will refund the value of the items that you have cancelled back to your card / Paypal account.
Delivery of goods to you
a. The Climbing Book Shop will post, or arrange a courier on your behalf, for the goods ordered by you to the person and address you give the Climbing Book Shop at the time you make your order.
b. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of despatch of the order. All delivery times quoted on the website are estimates only, based on availability, normal processing and delivery companies.
c. You will become the owner of the goods you have ordered when the goods are despatched to you.
Liability
This is as follows:
a. If the goods The Climbing Book Shop delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, The Climbing Book Shop shall have no liability to you unless you notify the Climbing Book Shop of the problem, in writing to gareth@rockclimbinguk.co.uk within 10 working days of the delivery of goods in question.
b. If you do not receive goods ordered by you within 30 days of the date on which they were despatched to you, The Climbing Book Shop shall have no liability to you unless you notify The Climbing Book Shop in writing at the the Climbing Book Shop’s contact address of the problem within 40 days of the date on which the goods were despatched to you.
c. If you notify a problem to The Climbing Book Shop’s under this condition, The Climbing Book Shop’s only obligation will be, at its option, to make good any shortage or non-delivery; to replace any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment, unless such method is no longer valid in which case The Climbing Book Shop’s e-coupons will be issued to the value of the refund due.
d. The Climbing Book Shop will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to The Climbing Book Shop under this condition and The Climbing Book Shop shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.
e. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit The Climbing Book Shop’s liability to you for any death or personal injury resulting from its negligence.
Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.
Force Majeure
The Climbing Book Shop shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Invalidity
If any part of these conditions is unenforceable (including any provision in which The Climbing Book Shop excludes its liability to you) the enforceability of any other part of these conditions will not be affected.
Complaints
The Climbing Book Shop operate a complaints handling procedure which is used to try to resolve disputes when they first arise. If you have a complaint, please contact Gareth Hanson at the following address:

Governing Law
The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.
Disclaimer
The nature of Internet communications means that your communications may be susceptible to data corruption, interception and delays. The Climbing Book Shop shall not be responsible for any detrimental reliance you place on this website or its contents.
The Climbing Book Shop is providing this site and its contents (including any downloadable data or software) on an ‘as is’ basis and makes no representations or warranties of any kind with respect to this site or its contents and disclaims all such representations and warranties, whether express or implied, to the fullest extent permitted by applicable law. Interpretation
In these terms and conditions:-
‘The Climbing Book Shop’ means Gareth Hanson of 24 Westfield Rise, Hessle, East Yoprkshire, trading as The Climbing Book Shop.
‘working day’ means every day of a calendar year apart from weekends and statutory and public holidays;
‘us’ means The Climbing Book Shop and you together; and
‘you’ and ‘your’ means the person ordering goods under these terms and conditions.
The Climbing Book Shop Returns Policy

Faulty goods:
If you find a product to be faulty upon delivery please return it immediately. We can either replace (subject to availability) or refund. If we deliver a faulty item we will refund you for the cheapest insurable rate for the consignment based upon Royal Mail’s pricing at the time. See postal advice below.
If you find the item you bought not to be as you expected, we will happily exchange or refund it. Goods must be returned as new, as supplied and in a saleable condition.
Who pays for the return post?
We will refund you and pay for the postage if:
- We sent you something incorrectly. We would also post the replacement to you post free. In the event that you choose a refund your original postal charge would be refunded as well.
- We sent you something that was faulty or broken when delivered. We would also post the replacement post free. In the event that you choose a refund your original postal charge would be refunded as wel
You pay the postage if:
- You change your mind about something and decide to send it back for an exchange or refund. In the event of a refund, you would be refunded for the goods but not the original postage. In the event of an exchange, you would have to pay for the cost of the additional postage to get the replacement to you.
Which method of post should I use for returning items?
- Value less than £30.00, weight less than 1kg: use Royal Mail 1st Class Recorded Delivery
- Value less than £30.00, weight more than 1kg but less than 2kg: use Royal Mail Special Delivery
- Value more than £30.00, weight less than 2kg: use Royal Mail Special Delivery
- Value more than £30.00, weight more than 2kg Royal Mail Insured Parcels
Always keep your post office receipt and tracking number so that in the event your parcel goes missing you will be able to trace it or claim for its value from the Post Office.
